THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMARTMONEYSAVE AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL; OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF USD $50 OR THE AMOUNT YOU PAID US (IF ANY) IN THE 3 MONTHS BEFORE THE CLAIM AROSE.

14) Indemnification

You agree to defend, indemnify, and hold harmless SmartMoneySave from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services, (b) your content, or (c) your violation of these Terms or any law.

15) Suspension & Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including suspected violations of these Terms. Sections that by their nature should survive (e.g., IP, disclaimers, liability limits, indemnity) shall survive termination.

16) Governing Law & Dispute Resolution

These Terms are governed by the laws of Türkiye without regard to conflict-of-law principles. You agree to the exclusive jurisdiction and venue of the courts located in Istanbul, Türkiye to resolve any dispute arising out of or relating to the Services or these Terms. If a court finds any provision unenforceable, the remaining provisions remain in full force.

17) International Use

We operate from Türkiye and do not represent that the Services are appropriate or available in all locations. Accessing the Services where they are illegal is prohibited. You are responsible for compliance with local laws.

18) Electronic Communications & Consent

By using the Services or contacting us, you agree to receive communications electronically. We may communicate via email or by posting notices on the site. You consent to electronic records related to your use of the Services.

19) Entire Agreement

These Terms, together with our Policies, constitute the entire agreement between you and SmartMoneySave regarding the Services and supersede any prior agreements on the same subject.
